These Terms of Service (“Terms”) govern your use of the Divvy web application at joindivvy.app and the guides site at guides.joindivvy.app (together, the “Service”), operated by Roy Toone, an individual sole proprietor (“Divvy,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Divvy is
Divvy is a coordination tool that helps roommates plan a move-in together — claiming shared items, proposing and voting on options, and separating shared from personal belongings. Divvy is a planning and coordination tool only. We do not sell products, process purchases, or guarantee that any item will be bought or brought by any person.
2. Eligibility
You must be at least 13 years old (16 or older where required by local law) to use the Service. By using Divvy, you represent that you meet this requirement.
3. Your account
You sign in through Google or Apple. You are responsible for the activity on your account and for keeping your sign-in credentials with those providers secure. You provide a display name that other members of your spaces can see, and you agree it will not be misleading, offensive, or impersonate someone else.
4. User content
You retain ownership of the content you add to Divvy (spaces, items, notes, links, photos, comments). By adding content, you grant us a limited license to store, display, and process it solely to operate the Service for you and the members of your spaces. You are responsible for the content you post and must have the right to post it. Do not upload content that is unlawful, infringing, harmful, or violates someone else’s privacy.
5. Acceptable use
You agree not to: use the Service for any unlawful purpose; harass, threaten, or abuse other members; attempt to access data that isn’t yours or circumvent the Service’s privacy controls; interfere with or disrupt the Service; or scrape, reverse-engineer, or misuse the Service. Within a shared space, claims belong to the member who made them, and disagreements are resolved through Divvy’s proposal and voting flow — not by overriding other members.
6. Affiliate links
The guides site contains affiliate links. If you click them and make a purchase, we may earn a commission at no additional cost to you. We provide an affiliate disclosure on the guides site. We are not responsible for the products, prices, availability, or conduct of any third-party merchant, and any purchase you make is between you and that merchant.
7. Fees and future paid features
The Service is currently free. We may introduce paid features in the future (for example, a one-time unlock per group). If we do, the terms and pricing will be presented to you before you are charged, and signing up for and using the core Service will not require payment.
8. Third-party services
The Service relies on third parties including Google, Apple, Lovable/Supabase, WordPress.com, and affiliate networks. Your use of those services is governed by their own terms, and we are not responsible for them.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any coordination done through it will result in a particular outcome.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DIVVY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the prior 12 months or USD $50.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.
12. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and update the “Last updated” date. Continued use of the Service after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules.
